i was hit by a car w/ my child on my bike on highland ave sunday afternoon

just wanted to give people a heads up.


we are relatively ok. my little one sustained some bumps and bruises, i took the brunt of the fall. motorist refused to believe there was a bikelane on highland.


more details to come after i finish the paperwork/etc.

doesn't matter if there is a bike lane or not. you have the right to a full lane if you need it. its the driver's job to not run you over, not your job to stay out of the way.

That's terrible. Glad you are both ok. Bike lane or not a driver can't use that as an excuse for hitting you.

Irrespect of sharrows, cautionary signage or your speed, any vehicle, motorized or otherwise, must exercise caution when overtaking or intersecting the path of another vehicle, motorized or otherwise.

As has been remarked before, if you are pursuing a claim about the accident you should probably refrain from making any statements on here until you are in the clear to do so.

+1 on not posting details on here until the claim is said and done, not that we don't want to be supportive or provide help, but a decent lawyer or keeping the insurance/motorist honest is tricky when things can't go unsaid. and hopefully the paperwork includes filing police report.


VERY glad you and the lil' one are ok.


How does one post to the map? I'd suggest that you post an accident to the accident map, but I don't know how to do that.

wow, that sucks, glad you're "relatively" ok and hope that really means "ok" and not "messed up".


i definitely echo the "don't post details" sentiment (probably including not posting to the accident map) until everything is resolved. call a lawyer and maybe call the police. bike lane, sharrows, etc are completely immaterial.

Sorry to hear this. My wife is often out with my little one in a trailer... this is my worst nightmare. Glad everyone is relatively OK.

It's very chilling to hear of your accident. I have been riding with mine on the bike since my oldest was big enough for it, both in the trailer and in the seat. I'm sure I've probably taken for granted that because I hadn't had an accident (yet), that we were completely safe. This is a reminder to double-down on the caution and be as careful as I can, although I'm sure you were doing the same.


I'm really glad to hear you both survived it in good condition. I hope this won't cause fear or anxiety to linger for your little one (or yourself). I'm looking forward to hearing more about what happened when your legal/insurance issues settle.


(BTW, was this covered in either newspaper?)

I would recommend documenting anythign and everything. record names and times of everyone you talk to and what was said. No such thing as too much documentation. If you haven't and even if you think it is minor, get checked out by a doctor. You dont want something creeping up down the road and not being able to get compensated.


I would recommend writing up your own version of the events.. what led up to it, how things happened on scene, behavior of those involved, anything you can think of and recall, on paper.. mail a copy to your insurance, yourself and a lawyer if you have one.

If you feel you are being played, definitely retain a lawyer.. I know there are people that have used Reisman with good luck. http://gelmanreisman.com/bikepage.html
