Seriously...how does anyone, anywhere, even conceive of this as a valid argument?
the sad thing is that there are lawyers who will exploit that. i once attended an autopsy where there were two people that were killed by a drunk driver. the drunk went off of an upper road and landed on the car below, killing the two passengers instantly. they still had to perform the autopsy to prove that they died from the crash and not from something else. they had to remove their brains to take pictures of the brain hemorrhage that happened as a result because they said that lawyers can argue otherwise.

BLOOMFIELD, Pa. -- A motorcyclist is in critical condition after a crash in Bloomfield, police said.
The crash happened just before midnight when the motorcycle broadsided a car on Baum Boulevard, officials said.
The driver’s name has not been released.
I was at Presby all night. I can't believe that they say he broadsided a car. WTF! He was in the far right lane on Baum and a car came out of control barreling toward him skidding and collided on his left side. Luckily the driver was not able to leave the scene as they so often do with the bicycle crashes. I presume the driver was drunk, but we'll see.
Tabby, so sorry to hear of your brother's incident. Hope he heals fast and well, and that he's out of any serious danger soon. Hopefully, local law enforcement will fugure out what REALLY happened in this case.
thanks for that, Swalfoort. He has lots of broken bones, but his injuries do not appear life-threatening.
I'm scared for him- I think it's going to be pretty overwhelming to take in. And then I'm scared for all of us out there being vulnerable to the larger, faster vehicles on the road.

I ride Baum all the time & generally feel safe on it, but this is really scary. Tabby, I'm so sorry to hear that this happened to your brother & hope that he heals as best as he can. Hope they did a breathalyzer on the driver right away. I've had a couple of close calls on Baum @ Aiken/Liberty: mostly due to drivers being greedy about turns in one form or another.
Tabby, sorry to here about this - I hope your brother has a full and speedy recovery.
WTAE’s noon news showed a photo of the car and it was heavily damaged across the whole side of the vehicle - as if your brother tried to lay the bike down in an effort to avoid the collision; very inconsistent with the description of the motorcyclist broad-siding the car.
p.s. – as with most accidents, it’s probably best not to give too many accident details on the internets

I was frustrated to hear the usual 2-wheel bias in the initail news reports. I'm hoping though that whatever really happened comes through in the report and that they got all the evidence they need.
Tabby, this sounds awful. Hope your brother is up and about as soon as possible, and justice is served in the legal wrangling that is sure to ensue.
Sorry to hear about your brother - hope he comes out OK and they eventually sort out the real story. Definitely motorcyclists have a lot of the same problems as bicyclists out there on the road.
